Quest Training and Development

TERMS AND CONDITIONS FOR BOOKING TRAINING COURSES


1 Public Training Courses


1.1 Public Training Courses and Prices


The details of the design and content and the prices are correct at the time of publication, but are subject to change without notice.


The cost of optional overnight accommodation is not included in the course fees.


Quest Training and Development  reserves the right to cancel or reschedule courses without penalty or liability if there are booking

which it deems to be insufficient, or for reasons outside its control. Quest Training and Development  will try to notify participants as

soon as reasonably possible if a course has to be cancelled.


Invoices are due for payment within 30 days of the invoice date without any deductions including, but not limited to, bank charges.

Time of payment shall be of the essence and accordingly Quest Training and Development may treat failure to pay any of its invoices

on time as a repudiation of the contract on your part and may also treat itself as discharged from its own contractual obligations. If no

payment is received Quest Training and Development will assume cancellation of booking and contract terminated or reserve the

right to charge interest from the due date until payment (See ‘General’ Clause 1.4).


1.2 Cancellation Policy


In respect of cancellation by Quest Training and Development. a full refund will be given upon return to us of any pre-course

materials already despatched. Quest Training and Development may ask for written confirmation that the materials have not been

copied.



Quest Training and Development  reserves the right to charge the full course fee for any cancellation by a participant for any reason

within 14 days of the start of the training course.  If between 14-21 days notice is given, we reserve the right to charge 50% of the

course fee. No fees will be payable, except for a charge for any course material already dispatched, for any cancellation received in

writing more than 21 days before the course start date.


Participant substitutions can be accepted, without charge, at any time provided that the substitute fulfils the entrance requirement.


1.3 Qualifications of Participants


Registrants on qualification courses should note that successful completion of such courses requires participants to demonstrate an

understanding of the underlying principles and competence in the selection, administration and feedback of the topics concerned.

Whilst Quest Training and Development will make every reasonable effort to ensure a high standard of training and impartiality in

such awards, no guarantee is given that every participant attending will receive such qualification.


2 In-House Training Courses


In-House training course programs can produce significant savings where a client has a number of participants wishing to attend

public training courses Fees for these courses will be provided on request.


2.1 Arrangements:-


The details and requirements for the in-house course will be agreed at the time the course is booked. In general, however, in addition

to the agreed course fees we ask the client to provide and/or pay for the following:


The training venue. audio and visual equipment.


All meals and refreshments during the course.


Travel and accommodation for the trainer(s). Unless previously agreed as included in the course.


The cost of transport by courier of equipment and materials to and from the venue. Unless previously agreed as included in the course.


Volunteers for administration and feedback practice


Other terms and conditions will be as for the Public Training Courses.



3 Distance Learning Course


3.1 Distance Learning Course and Prices


The Price is payable prior to the delivery of the Materials (in full) by cheque or BACS.


The price payable includes all materials and full support but does not include certification fees (unless previously agreed)


Under no circumstances shall we be deemed to have received payment until payment has actually been received by us in full and in

cleared funds.


Invoices are due for payment within 30 days of the invoice date without any deductions including, but not limited to, bank charges.

on time as a repudiation of the contract on your part and may also treat itself as discharged from its own contractual obligations.  If

no payment is received Quest Training and Development will assume cancellation of booking and contract terminated or reserve the

right to charge interest from the due date until payment (See ‘General’ Clause 1.4).


Delegates are required to satisfactorily complete the full course to qualification standard within 12 months of the booking date. In

exceptional circumstances, an agreed extension will be offered at Quest Training and Development discretion only. If the course is not

completed within 12 months  of the date of the booking, Quest Training and Development assume cancellation and contract

terminated. No refund will be given.


3.2 Delivery and Care of the Materials


Quest Training and Development will release all the materials (‘Materials’) to the participant in one despatch usually within 7/10

working days of receiving payment from you in cleared funds.



Materials will be sent by post or courier to the address the participant has given us.


The participant will inspect the materials upon delivery and will inform us immediately if there are any damages or omissions.


The participant will be deemed to have accepted the Materials if the participant does not notify us within seven days after delivery.


Risk of damage or loss in the Materials will pass to the participant upon despatch by post or courier.


3.3 Support


The participant will be provided with support and tuition as set out in the materials provided, in addition the participant will receive

such telephone and email assistance as we reasonably deem necessary and further support on the practical day.


Registrants on qualification courses should note that successful completion of the distance learning courses requires the participant

to attend the practical day in order to demonstrate an understanding of the underlying principles and competence in selection,

administration and feedback of the instrument(s) concerned.


3.4 Cancellation Policy


Under the Consumer Protection (Distance Selling) Regulations 2000 the participant has a right to cancel this contract by notifying

Quest Training and Development in writing within the first 7 days after receiving the course materials.


Upon cancellation the participant must return the Materials to Quest Training and Development  in good usable condition. Upon

receipt of returned materials to Quest Training and Development premises and on condition they have not been damaged or marked

in any way, then the participant will receive a full refund, minus the cost of postage and packaging. If Quest Training and

Development has to collect the Materials from the participant then Quest Training and Development may charge the participant

reasonable costs for doing so.


4 General


Quest Training and Development has a duty to change and/or update the training courses in line with the standards as laid down by

the RC(UK). We will advise delegates of changes if affected by new standards and provide suitable guidance in accordance.

Prices and specifications of Training and Services are correct at the time of publication on our website or other relevant literature but

are subject to change without notice.


You agree to provide us promptly with such information as we may reasonably require from you in connection with the provision of

our services.


The time for payment of all sums due to us shall be of the essence. If any invoice is not paid on the due date then Quest Training and

Development  reserve the right to charge interest from the due date until payment, in accordance with the Late Payment of

Commercial Debts (Interest) Act 1998 and to levy administration charges in accordance with the provisions of that Act.



We shall be entitled to terminate our agreement with you in any of the following circumstances:-


You commit a material breach of your obligations which breach (if capable of remedy) is not remedied within seven days of receipt of a written notice from us requiring the breach to be remedied; 



A petition is presented for your bankruptcy or (if a limited company) a petition is presented or a resolution is passed for the winding up of the company. 


You make a composition generally with your creditors. 


In any of these events we may at our discretion suspend the performance of our obligations as an alternative to terminating this agreement, such suspension to be for such period and upon such conditions as we reasonably deem fit.


We will not be liable for any indirect special or consequential loss (including, without limitation, loss of turnover or profit, goodwill

anticipated savings and expenditure).  In any other case, save for fraud or wilful default on our part and save also for death or

personal injury caused by our negligence, our liability, whether arising under contract, tort or under statute or otherwise, shall be

limited to direct losses suffered by you as a result of our acts or omissions and shall not exceed the amount of our charges for the

course in connection with which the claim arises. 


Any failure on our part to enforce at any time or for any period any one or more of the provisions of this Agreement shall not be waiver by Quest Training and Development of any provision or a waiver on our part subsequently to enforce all terms and conditions. 


No variations to these terms and conditions shall have any effect unless agreed in writing by Quest Training and Development


Exclusions. Any condition, representation or warranty that might otherwise be implied or incorporated within these terms and

conditions by reason of statute or common law or otherwise is hereby expressly excluded to the fullest extent permitted by law.


Variation. These terms and conditions shall apply to the exclusion of all other terms and conditions, including any that you attempt to

apply under any purchase order, booking confirmation or any other document; and, no variation of these terms and conditions shall

be effective unless in writing and signed on behalf of Quest Training and Development.



Quest Training and Development reserve the right to amend the Terms and Conditions as laid out in this document, without prior

notice.
